These Terms & Conditions ("Terms") govern your use of trainatlead.com (the "Site") and the services provided by LEAD Athletic Performance, Inc. and/or LEAD Hoops LLC ("LEAD," "we," "us," or "our"). By using the Site, submitting a form, or enrolling in any program, you agree to these Terms.

2. Eligibility and Minors
You must be at least 18 years old to enter into these Terms. If the athlete is under 18, a parent or legal guardian must review and accept these Terms on the athlete's behalf, provide all required information, and assume responsibility for the athlete's participation and account.
3. Services
LEAD provides strength, conditioning, and athletic performance training, including group training, private coaching, team training, camps, and events. Program details, schedules, and capacity are subject to change.
4. SMS / Text Messaging Terms
Program description. By providing your mobile number and affirmatively consenting, you agree to receive text messages from LEAD related to your account, scheduling, training programs, and — if you have consented to marketing — promotional offers and program announcements.
Consent. Consent is obtained through an unchecked, optional checkbox on our web forms and chat widget, on paper forms at our facility, or by texting us directly. Consent to receive text messages is not a condition of purchasing any goods or services from LEAD.
Message frequency. Message frequency varies. You will typically receive no more than 4–8 messages per month.
Cost. Message and data rates may apply. These charges are billed by and payable to your mobile carrier.
Opt-out. You may opt out at any time by replying STOP to any message from us. After you reply STOP, we will send one confirmation message and will not send you further messages unless you opt in again.
Help. For help, reply HELP to any message, or contact us at (916) 426-2812 or info@trainatlead.com.
Carrier disclaimer. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier and is not guaranteed.
Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details on how we handle your information.
Supported carriers. Message delivery is supported on major U.S. wireless carriers.
5. Memberships, Payments, and Billing
Recurring billing. LEAD memberships are billed on a recurring basis according to the plan you select. By enrolling, you authorize LEAD to charge your payment method on file on each billing date until you cancel.
Cancellation. You may cancel your membership in accordance with the cancellation terms of your specific membership agreement. Cancellation requests must be submitted in writing to info@trainatlead.com.
Refunds. Membership fees, session packages, camps, and event fees are non-refundable except as required by law or as expressly stated in your membership agreement.
Failed payments. If a payment fails, LEAD may suspend access to services until the balance is resolved.
Price changes. LEAD may change pricing with reasonable advance notice.
6. Scheduling, Attendance, and Missed Sessions
Sessions must be scheduled and canceled in accordance with the policies communicated to you at enrollment. Sessions missed without adequate notice may be forfeited.
7. Assumption of Risk and Release
Physical training carries inherent risk of injury. By participating, you acknowledge and voluntarily assume all risks associated with training at LEAD, including risk of serious injury.
You represent that you (or the athlete, if a minor) are in good physical condition and have no medical condition that would prevent safe participation, and that you have disclosed any relevant medical or injury history to LEAD.
To the fullest extent permitted by law, you release LEAD, its owners, coaches, employees, and agents from liability for injury, loss, or damage arising from participation, except where caused by gross negligence or willful misconduct.
A separate waiver and release may be required prior to participation and, where signed, controls in the event of a conflict with this section.
8. Health Information
Any health, injury, or medical information you provide is used solely to deliver safe and appropriate training. LEAD does not provide medical advice, diagnosis, or treatment. Consult a physician before beginning any training program.
9. Facility Conduct
Clients and guests are expected to follow facility rules, coach instruction, and standards of respectful conduct. LEAD reserves the right to suspend or terminate membership for conduct that endangers or disrupts others.
10. Intellectual Property
All content on the Site — including text, images, video, logos, program design, and training materials — is the property of LEAD and is protected by intellectual property law. You may not copy, reproduce, distribute, or create derivative works without our written permission.
11. Media Release
LEAD may photograph or record training sessions for marketing and educational purposes. If you do not wish for you or your athlete to appear in LEAD media, notify us in writing at info@trainatlead.com.
12. Disclaimer of Warranties
The Site and services are provided "as is" and "as available." LEAD makes no warranties, express or implied, regarding specific athletic outcomes, performance improvements, or results.
13. Limitation of Liability
To the fullest extent permitted by law, LEAD's total liability arising out of or relating to these Terms or the services shall not exceed the amount you paid to LEAD in the twelve (12) months preceding the claim. LEAD is not liable for indirect, incidental, consequential, or punitive damages.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute shall be brought in the state or federal courts located in Placer County, California.
15. Changes to These Terms
LEAD may update these Terms at any time. Changes take effect when posted with a revised "Last Updated" date. Continued use of the Site or services constitutes acceptance of the updated Terms.
Privacy Policy
LEAD AThletic Performance, Inc. and LEAD Hoops LLC ("LEAD," "we," "us," or "our") operates trainatlead.com (the "Site") and provides athletic performance training services. This Privacy Policy explains what information we collect, how we use it, and the choices you have.

Information you provide directly. When you submit a form on our Site, use our chat widget, book a session, or contact us, we may collect:

Performance and training data. For active clients, we collect training and testing data generated during sessions, including force plate measurements, velocity and load data, attendance, and program history.

4. SMS / Text Messaging
We do not share, sell, rent, or otherwise disclose mobile phone numbers or SMS consent data to any third parties or affiliates for their own marketing purposes. Mobile opt-in information and consent are used solely by LEAD to deliver the messages you requested and are not shared with third parties, except with service providers who help us operate our messaging platform and who are prohibited from using this information for any other purpose.
How you opt in. You may consent to receive text messages from us by checking the SMS consent box on a form on our Site, in our chat widget, on a paper form at our facility, or by texting us directly. The SMS consent checkbox on our forms is unchecked by default and is optional. Consent to receive text messages is not a condition of purchasing any product or service.
Types of messages you may receive. Depending on the consent you provide, we may send:

Transactional / informational messages: appointment confirmations and reminders, schedule changes, facility closures, account and billing notifications, and responses to your inquiries.

Marketing / promotional messages: new program launches, camps and events, and special offers.

5. How We Share Information
We do not sell your personal information.
We may share information with:

Service providers who perform services on our behalf, including our customer relationship management platform, messaging provider, scheduling and payment processors, training software providers, and email delivery services. These providers are contractually limited to using your information only to provide services to us.

Legal and safety purposes, where required by law, subpoena, or court order, or where necessary to protect the rights, safety, or property of LEAD, our clients, or others.

Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
As stated in Section 4, mobile phone numbers and SMS consent data are never shared with third parties or affiliates for marketing purposes.
6. Minors
Many of our clients are under 18. We do not knowingly collect personal information from children under 13 without verifiable parental consent.
For any athlete under 18, a parent or legal guardian must provide the athlete's information, sign all agreements, and provide any SMS consent. Where a parent or guardian has provided their own mobile number, text messages will be directed to the parent or guardian.
If you believe we have collected information from a child without appropriate consent, contact us at info@trainatlead.com and we will delete it.
7. Cookies
Our Site uses cookies and similar technologies to operate the Site, remember your preferences, and understand how visitors use the Site. You can set your browser to refuse cookies, though some parts of the Site may not function properly as a result.
8. Data Security
We use commercially reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Data Retention
We retain personal information for as long as necessary to provide our services, maintain training records, comply with legal and tax obligations, and resolve disputes. When information is no longer needed, we delete or de-identify it.
